மனு ஸ்மிருதி குறித்துப் பன்னெடுங்காலமாகப் பற்பலர் ஏதேதோ உளறி வருகிறார்கள். இவர்களுக்குப் பதில் சொல்வது வெட்டி வேலை. எனினும், நமக்குச் சில அடிப்படை விஷயங்கள் தெரிந்திருப்பது நல்லது என்பதால் வரலாற்று ரீதியான சில விவரங்களைத் திரட்டியுள்ளேன். அவற்றை இங்கே தருகிறேன்

மேலே படிக்கும் முன்பு –

1. இவை அனைத்தும் விக்கிபீடியாவில் மனுஸ்மிருதி என்ற தலைப்பில் உள்ள விஷயங்கள் மட்டுமே. நான் அந்த மிகப் பெரிய கட்டுரையில் சிலவற்றை மட்டும் தேர்ந்தெடுத்துத் தந்துள்ளேன்.

2. வெர்பாடிம் மொழிபெயர்க்கவில்லை. எனினும், டீவியேட் ஆகாமல் தமிழில் தந்திருக்கிறேன். (டைல்யூட் ஆவதும் ஓரளவு உருமாறுவதும் தவிர்க்க முடியாதவை.) எனவே, இந்தத் தமிழ் வடிவத்தை எந்த இடத்திலும் மேற்கோள் காட்டிப் பேச வேண்டாம். முழுக்க முழுக்க எக்ஸாக்ட் வடிவம் தேவை என விரும்புபவர்கள் ஆங்கில வடிவத்தைப் படிக்கவும்.

3. இவை வரலாற்று ஆய்வாளர்களின் கருத்துகள் மட்டுமே. நமது பெரியவர்கள் – குறிப்பாக, மதத்தலைவர்களாக விளங்கும் மடத்தலைவர்கள் – இத்தகைய ஆராய்ச்சிகள் குறித்து அலட்டிக்கொள்ள மாட்டார்கள். அவர்கள் வழியில் நாமும் இதில் காணப்படும் கருத்துகளைப் பொருட்படுத்த வேண்டியதில்லை.

இதுபோன்ற மேலோரைப் பொறுத்த வரை, ”உலகில் தர்மம் நிலைக்க வேண்டும் என்பதற்காக அளவிலாக் கருணையுடன் மகரிஷிகள் நமக்கு ச்ருதிகளையும் ஸ்மிருதி, இதிஹாஸ, புராணங்களையும் வழங்கியுள்ளார்கள். அவர்கள் நமக்குச் செய்திருக்கும் உபகாரத்துக்கு நாம் கடமைப்பட்டவர்களாக இருக்க வேண்டும். இருக்க முடியாவிட்டாலும், அவர்களது கருணைப் பிரவாகத்தை நமது பகுத்தறிவின் எல்லைக்குள் கொண்டுவந்து ஆராய்ச்சி செய்யாமலாவது இருக்கலாம்.”

இத்தகைய பெரியவர்களின் கருத்தைத்தான் நாம் ஏற்க வேண்டும். இருந்தாலும் அதேநேரத்தில், ‘அறிவுபூர்வ’மாகப் பேசும் ‘அதிபுத்திசாலி’களைக் கையாள வேண்டி வரும் துரதிர்ஷ்டமான சந்தர்ப்பங்களில் இந்த வரலாற்று ஆய்வு முடிவுகள் உங்களுக்குப் பயன்படும்.

மனுஸ்மிருதி என்ற பெயரில் தற்போது புழக்கத்தில் இருக்கும் நூலை ஒரிஜினல் மனுஸ்மிருதி என்று ஏற்றுக்கொள்ள முடியாது.

இப்போது வரை ஐம்பதுக்கும் மேற்பட்ட மனுஸ்மிருதி மூலப் பிரதிகள் கிடைத்துள்ளன. இவற்றில், 18 ஆம் நூற்றாண்டில் கொல்கத்தாவில் கிடைத்த, குல்லூக பட்டரின் உரையுடன் கூடிய மனுஸ்மிருதி ஏட்டுச்சுவடிதான் முதலில் கிடைத்தது. இதையே மனுஸ்மிருதியின் ஒரிஜினல் வடிவம் என்று ஆங்கிலேயர்கள் நினைத்தார்கள். அடுத்தடுத்த காலங்களில் கிடைக்கப்பெற்ற தகவல்களை அடிப்படையாகக் கொண்டு பார்க்கும்போது ”கொல்கத்தாவில் கிடைத்த பிரதிதான் ஒரிஜினல் மனுஸ்மிருதி” என்ற கருத்து தவறானது என்பது நிரூபணமாகிறது.

இதுவரை பல்வேறு மூலப்பிரதிகள் கிடைத்துள்ளன. இந்த மூலப் பிரதிகள் ஒவ்வொன்றுக்கும் இடையே ஏராளமான வித்தியாசங்கள் உள்ளன. அதுமட்டுமல்ல, ஒரே ஒரு மூலப்பிரதிக்குள்ளேயே உள்ள இருவேறு இடங்களில் காணப்படும் கருத்துகள் ஒன்றுடன் ஒன்று ஒத்துப் போவதில்லை; முரண்பாடுகள் காணப்படுகின்றன.

எனவே, இவற்றில் ஏராளமான இடைச்செருகல்கள் ஏற்பட்டிருக்கின்றன என்றும், பல்வேறு பகுதிகள் பிற்காலத்தில் மாற்றப்பட்டிருக்கின்றன அல்லது சேர்க்கப்பட்டிருக்கின்றன என்றும்தான் நினைக்கத் தோன்றுகிறது. எனவே, இந்த மூலப்பிரதிகள் எதையுமே ஒரிஜினல் என்று ஏற்பதற்கில்லை.

Over fifty manuscripts of the Manusmriti are now known, but the earliest discovered, most translated and presumed authentic version since the 18th century has been the “Kolkata (formerly Calcutta) manuscript with Kulluka Bhatta commentary”. Modern scholarship states this presumed authenticity is false, and the various manuscripts of Manusmriti discovered in India are inconsistent with each other, and within themselves, raising concerns of its authenticity, insertions and interpolations made into the text in later times.

The foundational texts of Manusmriti include many of these sutras, all from an era preceding the common era. Most of these ancient texts are now lost, and only four of have survived: the law codes of Apastamba, Gautama, Baudhayana and Vasishtha.

பண்டைய இந்தியாவிலோ இடைக்கால இந்தியாவிலோ மனுஸ்மிருதி ஓர் ஆட்சி அதிகாரமிக்க சட்ட நூலாக இருந்தது என்ற கருத்தை ஆய்வாளர்கள் யாரும் ஏற்கவில்லை. ”இந்தியாவில் கடைப்பிடிக்கப்பட்டு வந்த பல்வேறு சட்டங்கள் மனுஸ்மிருதியில் இடம் பெற்றிருப்பதாகத் தற்கால இந்திய வரலாற்று நிபுணர்கள் யாரும் கருதவில்லை. ‘மேம்பட்ட சமுதாயத்தில் சட்டம் எவ்வாறு இருக்க வேண்டும் என்பது குறித்த ஒரு பிராமணீயப் பார்வைதான் மனுஸ்மிருதி’ என்று வேண்டுமானால் சொல்லலாம்” என்கிறார் டேவிட் பக்ஸ்பௌம்.

குஜராத், கேரளம், தமிழ்நாடு ஆகிய பகுதிகளின் இடைக்காலத்தைச் சேர்ந்த கல்வெட்டு ஆய்வுகள், அகழ்வாராய்ச்சி முடிவுகள், நூல் ஆய்வுகள் ஆகிய அடிப்படையில் இதர ஆராய்ச்சியாளர்களும் இதே முடிவுக்குத்தான் வருகிறார்கள். அதேநேரத்தில் தெற்காசியாவில் சட்டம் உருவாகி வளர்ந்த வரலாற்றில் மனுஸ்மிருதிக்கு கொள்கை ரீதியான பங்களிப்பு உண்டு என்றும் அவர்கள் கருதுகிறார்கள்

Scholars doubt Manusmriti was ever administered as law text in ancient or medieval Hindu society. David Buxbaum states, “in the opinion of the best contemporary orientalists, it [Manusmriti] does not, as a whole, represent a set of rules ever actually administered in Hindustan. It is in great part an ideal picture of that which, in the view of a Brahmin, ought to be law”.

Donald Davis writes, “there is no historical evidence for either an active propagation or implementation of Dharmasastra [Manusmriti] by a ruler or any state – as distinct from other forms of recognizing, respecting and using the text. Thinking of Dharmasastra as a legal code and of its authors as lawgivers is thus a serious misunderstanding of its history”.

Other scholars have expressed the same view, based on epigraphical, archaeological and textual evidence from medieval Hindu kingdoms in GujaratKerala and Tamil Nadu, while acknowledging that Manusmriti was influential to the South Asian history of law and was a theoretical resource.

வெள்ளைக்காரன் செய்த குழப்பம்

இந்திய முஸ்லிம்களைப் பொறுத்தவரை, பிரிட்டிஷ்காரர்கள், ஷரியாவை முஸ்லிம்களுக்கான சட்டங்களாக ஏற்றுக் கொண்டனர். இந்த ஷரியா என்பது ஔரங்கசீப் ஆதரவுடன் எழுதப்பட்ட அல்-ஸிர்ஜ்ஜியா, ஃபதாவா-இ-ஆலம்கிரி ஆகியவற்றின் அடிப்படையில் அமைந்திருந்தது.

இந்தக் காரணத்தால்தான் அவர்கள் ஹிந்து தர்ம சாஸ்திர நூல்களில் மனுஸ்மிருதியை முதலில் (ஆங்கிலத்துக்கு) மொழிபெயர்த்தனர் (1794 ஆம் ஆண்டு). பிரிட்டிஷ் காலனி அதிகாரிகள் (இங்கிலாந்தில் இருந்தது போன்ற) அரசாங்க சட்டம், மதம் ஆகிய (இரண்டு) பிரிவுகளில் தங்களது (இந்திய) காலனியை நிர்வகிக்க முயன்றனர்.

எனவே, தங்களது அன்றாட நிர்வாகத்தில் அரசாங்க சட்டம், மதம் ஆகியவற்றின் அடிப்படை அம்சங்களை அவர்கள் மனுஸ்மிருதியில் இருப்பது போலவே ஏற்படுத்தினார்கள்.

ஆனால் மனுஸ்மிருதி என்பது தர்மம், சட்டம் ஆகியவை குறித்த வர்ணனை மட்டும்தானே தவிர, நீதிநிர்வாகத்துக்கான சட்டவிதிகளின் தொகுப்பு அல்ல என்பதை அவர்கள் புரிந்து கொள்ளவில்லை. (ஒரு நூற்றாண்டு கழிந்த பின்னர்) 19 ஆம் நூற்றாண்டின் ஆரம்ப கட்டத்தில் இருந்த காலனி அதிகாரிகளும்கூட இந்த விஷயத்தைச் சரியாகப் புரிந்து கொள்ளவில்லை.

இந்தியாவில் எத்தனையோ தர்ம சாஸ்திர நூல்கள் இருந்தன என்பதையோ, இவையனைத்தும் ஒன்றுக்கொன்று இணையானவை என்பதையோ, அந்த நூல்களில் ஒன்றான மனு ஸ்மிருதியும் இதுபோன்றதே என்பதையோ அவர்களால் புரிந்து கொள்ள முடியவில்லை.

இந்தியாவில் இஸ்லாமிய ஆதிக்கம் நிலவி வந்த பல நூற்றாண்டுகளாக மனுஸ்மிருதி புழக்கத்திலேயே இல்லாமல் போய்விட்டிருந்தது என்பதையும் கூட அவர்கள் புரிந்து கொள்ளவில்லை. இத்தகைய அதிகாரிகளால் மனுஸ்மிருதிக்கு விசேஷ அந்தஸ்து கிட்டியது. அந்த அதிகாரிகள் (காலனி ஆதிக்கத்துக்கு உட்பட்ட) தெற்காசியப் பகுதிகளில் எவ்வாறு முஸ்லிம்களுக்கு ஷரியா அடிப்படையில் அரசு நிர்வாகத்தை வழங்க வேண்டும் என்ற கொள்கையைப் பின்பற்றினார்களோ, அதுபோலவே, ஹிந்துக்களுக்கும் (ஏதாவது ஒரு மத நூல் அடிப்படையில்) நிர்வாகத்தை ஏற்படுத்த வேண்டும் என்று கருதி, தங்களுக்குத் தேவையான சட்ட விதிகளை மனு ஸ்மிருதியில் இருந்து எடுத்துக் கொண்டனர்.

இதனால், (காலனி ஆதிக்க காலத்தில் எழுதப்பட்ட) ஆங்கிலேய-ஹிந்து சட்டங்களின் உருவாக்கத்தில் மனு ஸ்மிருதி முக்கியப் பங்கு வகித்தது. அதுமட்டுமல்ல, பண்டைக்கால, இடைக்கால ஹிந்து கலாசாரத்தைப் பற்றிய மேற்கத்தியர்களின் பார்வையும் மனு ஸ்மிருதியை அடியொற்றியதாகவே அமையத் தொடங்கியது. எனவே, ஹிந்து கலாசாரம் பற்றிய மேற்கத்தியர்களின் கருத்துகளும் மனு ஸ்மிருதி அடிப்படையிலேயே அமைந்தன.

காலனி ஆதிக்க கால இந்திய நிர்வாகத்தில் மனு ஸ்மிருதிக்கு எவ்வளவு முக்கியத்துவம் இருந்தது, நிர்வாகத்தில் அதன் பங்களிப்பு எப்படி இருந்தது என்பது குறித்து அப்துல்லா அஹமது ஆன்-நய்ம் குறிப்பிடும் கருத்துகள் பின்வருமாறு (சுருக்கமான வடிவம்):

பிரிட்டிஷ் காலனி அரசு 1772 இல் ஹிந்துக்களுக்கும் முஸ்லிம்களுக்கும் உரிய சட்ட விதிகளை உருவாக்கத் தொடங்கியது. இது அடுத்த நூற்றாண்டு வரை தொடர்ந்தது. இந்தப் பணியின்போது அவர்கள் சில நூல்களுக்கு மட்டும் அதிக முக்கியத்துவம் கொடுத்தனர்.

ஒன்றையொன்று சார்ந்து விளங்கும் சிக்கல் நிறைந்த பல்வேறு சமுதாய விஷயங்களை வெறும் சட்டக் கண்ணோட்டத்தில் பார்க்க ஆரம்பித்ததன் பாதிப்புகள் ஏராளம். உதாரணமாக, பெண்கள் விஷயத்தைச் சொல்லலாம். இத்தகைய சட்டங்களின் விளைவாகப் பெண்களின் சமுதாய அந்தஸ்து குறித்த பல்வேறு அம்சங்கள் முடங்கி விட்டன.

இதனால், சமுதாய உறவுகளிலும் பொருளாதார ரீதியான தொடர்புகளிலும் கால ஓட்டத்தில் ஏற்படும் தொடர்ச்சியான மாறுபாடுகளுக்கு ஏற்ப பெண்கள் தங்களைத் தயார்செய்து கொள்ள முடியாமல் போனது. இதன் விளைவாக, பெண்களின் பல்வேறு உரிமைகள் பறிபோயின.

சட்டத்தைப் புரிந்து கொள்ளும் விஷயத்தில் காலனிய அதிகாரிகள் ஹிந்து சமுதாயத்திலும் முஸ்லிம் சமுதாயத்திலும் இருந்த முக்கியஸ்தர்களின் உதவியை நாடினார்கள். ஆட்களைத் தேர்ந்தெடுக்கும் விஷயத்தில் இன்னின்னார்தான் வேண்டும் இன்னின்னார் கூடாது என்று அவர்கள் கடைப்பிடித்த அணுகுமுறைகளே (பிரிட்டிஷ் இந்தியாவின்) அன்றாட வாழ்வியலுக்கான சட்டங்கள் பிராமணீய அடிப்படையிலும், இஸ்லாமிய அடிப்படையிலும் அமையக் காரணமாயின.

உதாரணமாக, ஆசிய நாடுகள் குறித்த விஷயங்களைப் பற்றி ஆராந்து வந்த வில்லியம் ஜோன்ஸ் என்பவர் 1792 இல் அல்-ஸிரிஜியாவை மொழிபெயர்த்தார்.

அதற்கு அவர் இட்ட பெயர் ‘முகமதியர்களின் வாரிசுரிமைச் சட்டம்’ என்பதாகும். மனு ஸ்மிருதியை 1794 இல் மொழிபெயர்த்த அவர், ‘ஹிந்து சட்ட அமைப்புகள் அல்லது மனுவின் சட்டங்கள்’ என்று அதற்குப் பெயர் சூட்டினார். மொத்தத்தில் பிரிட்டிஷார், (இந்தியாவில்) பல நூறு ஆண்டுகளாக உயிரோட்டத்துடன் விளங்கிய தார்மிக நெறிகள் அடங்கிய மத அமைப்புகளையும், சமுதாய அமைப்புகளையும் (நெறிப்படுத்துகிறோம் என்ற பெயரில்) நீர்த்துப் போகச் செய்தனர்.

முஸ்லிம்களுக்கும் ஹிந்துக்களுக்கும் மதச் சட்டங்கள் இப்படித்தான் இருக்க முடியும் என்று தங்களது ஐரோப்பிய மனங்களில் ஏற்கெனவே பதிவாகி இருந்த எண்ணங்களுக்கு ஏற்ற விதத்தில் (இந்தியாவின்) மத அமைப்புகளையும், சமுதாய அமைப்புகளையும் மாற்றி அமைத்தனர்.

For Muslims of India, the British accepted sharia as the legal code for Muslims, based on texts such the al-Sirjjiyah and Fatawa-i Alamgiri written under sponsorship of Aurangzeb. For Hindus and other non-Muslims such as Buddhists, Sikhs, Jains, Parsis and Tribal people, this information was unavailable. The substance of Hindu law, was derived by the British colonial officials from Manusmriti, and it became the first Dharmasastra that was translated in 1794. The British colonial officials, for practice, attempted to extract from the Dharmaśāstra, the English categories of law and religion for the purposes of colonial administration.

The British colonial officials, however, mistook the Manusmriti as codes of law, failed to recognise that it was a commentary on morals and law and not a statement of positive law. The colonial officials of the early 19th century also failed to recognise that Manusmriti was one of many competing Dharmasastra texts, it was not in use for centuries during the Islamic rule period of India. The officials resurrected Manusmriti, constructed statements of positive law from the text for non-Muslims, in order to remain faithful to its policy of using Sharia for the South Asian Muslim population. Manusmriti, thus played a role in constructing the Anglo-Hindu law, as well as Western perceptions about ancient and medieval era Hindu culture from the colonial times. Abdullahi Ahmed An-Na’im states the significance and role of Manusmriti in governing India during the colonial era as follows (abridged):

The [British] colonial administration began the codification of Hindu and Muslim laws in 1772 and continued through the next century, with emphasis on certain texts as the authentic ‘sources’ of the law and custom of Hindus and Muslims, which in fact devalued and retarded those dynamic social systems. The codification of complex and interdependent traditional systems froze certain aspects of the status of women, for instance, outside the context of constantly evolving social and economic relations, which in effect limited or restricted women’s rights. The selectivity of the process, whereby colonial authorities sought the assistance of Hindu and Muslim religious elites in understanding the law, resulted in the Brahminization and Islamization of customary laws [in British India]

For example, the British orientalist scholar William Jones translated the key texts Al Sirjjiyah in 1792 as the Mohammedan Law of Inheritance, and Manusmriti in 1794 as the Institutes of Hindu Law or the Ordinances of Manu. In short, British colonial administrators reduced centuries of vigorous development of total ethical, religious and social systems to fit their own preconceived European notions of what Muslim and Hindu “law” should be.
